If the Ethics Committee deems a complaint unfounded they may dismiss the complaint.

Where possible, the Ethics Committee may propose resolution of a complaint by negotiating a Consent Agreement with both parties.

Where the Ethics Committee deems it necessary, a Sanction Agreement may be created. The Sanction Agreement may require that the member continue to counsel only under specific conditions which may include, but are not restricted to:

supervision for an indicated period of time or number of counselling hours;

successfully complete specified classes or courses of instruction; and
-
obtain medical treatment and/or other treatment which may include, but not restricted to counselling.

Where deemed necessary due to professional incompetence or professional misconduct, the ACCT Board of Directors may impose any of the following:

have the member's name struck from the register;

suspend the member from the association for a specified period of time; and
-
suspend the member from the association pending the satisfactory completion of any conditions specified.
The Board of Directors may decide that the member pay to the Association (within a fixed period) a fine to cover the costs of the enquiry and hearing, in a specified amount.
Copies of the Ethics Committee’s or Board of Director’s decisions shall be sent to the member involved and the person who made the complaint. For the purpose of protecting the public and protecting the interests of ACCT and its membership, copies of the decisions may also be sent to the member's employer (if applicable), the ACCT Membership (via email and/or posted on the ACCT website), other professional associations, counselling colleges/training institutes and any other person or party deemed necessary.
Appeal
A member may appeal a decision within 30 days of receiving the decision.
